Hustler Words – A former engineer at Elon Musk’s artificial intelligence venture, xAI, has initiated legal proceedings against the company and its parent entity, SpaceX. The lawsuit alleges that Devin Kim was unjustly terminated after repeatedly voicing serious concerns regarding the safety protocols and ethical implications of Grok, xAI’s flagship AI chatbot.
Filed on Tuesday in a California state court, Kim’s complaint emerges just days before SpaceX is anticipated to make its public market debut, an event poised to be one of history’s largest initial public offerings. Kim departed from xAI in September 2025, according to the legal document.
The lawsuit, reviewed by Hustler Words, paints Kim as a vocal advocate for AI safety during his tenure working on Grok. He purportedly lodged numerous complaints about xAI’s perceived failure to prioritize safety in Grok’s development – a product that has since drawn criticism for various safety and behavioral issues. Specifically, Kim reportedly worried that Grok possessed the potential to foster discrimination and facilitate the dissemination of information related to weapons of mass destruction.

The legal filing cites instances where Grok’s behavior seemingly validated Kim’s warnings. "Grok, of course, proved Mr. Kim right by engaging in spectacular displays of online hatred and vitriol, with the model likening itself to Hitler (‘MechaHitler’)," the lawsuit states. Following this "Hitler debacle," Kim reportedly dedicated efforts to re-evaluate Grok’s political biases and discriminatory tendencies. Months after Kim’s departure, Grok again garnered negative attention when it was allegedly used to inundate X, Musk’s social media platform also under the xAI umbrella, with nonconsensual sexual imagery.
Kim’s legal action further positions him as a whistleblower, asserting that xAI’s alleged disregard for AI safety constituted "unlawful" conduct across several domains, including internet regulation, consumer protection, unfair business practices, and arms and explosives regulation. Kim’s commitment to AI safety predates his time at xAI; at Scale AI, he spearheaded initiatives to generate training data for AI systems designed to detect harmful content and ensure compliance. Notably, the nonprofit Center for AI Safety, focused on mitigating AI risks, recently appointed Kim as its president.
Intriguingly, the lawsuit does not directly implicate Elon Musk for the purported safety lapses. Instead, Kim’s legal representatives portray Musk as having instructed xAI to adhere to legal standards and implement robust safety and testing protocols. The primary target of the claim is Kim’s former supervisor, xAI co-founder Jimmy Ba, who left the company earlier this year. Ba is accused of disregarding Musk’s directives and retaliating against Kim for his persistent advocacy for safeguards, allegedly to "silence his repeated complaints about AI safety and biases."
The complaint characterizes Ba as vehemently opposed to AI safety measures, even allegedly telling Kim at one point, "AI will kill us all anyway." His alleged motivation was to propel xAI to be the first to achieve superintelligence, seemingly at the expense of safety.
Furthermore, the lawsuit claims that in August 2025, Ba attempted to circumvent EU safety regulations during the release of Grok Code 1, allegedly misrepresenting aspects of the model to bypass legally mandated testing. "Mr. Ba indicated that he would rather release an unsafe model than a poor-performing one. Mr. Musk ultimately had to intervene," the complaint states. Kim was reportedly scheduled to present his findings the week of September 15, 2025, but Ba instead summoned him to a meeting, informing him they should "go [their] separate ways" without providing a satisfactory explanation for the termination.
Hustler Words has sought comment from both xAI and SpaceX, but neither company immediately responded. Efforts to reach Jimmy Ba for his perspective were also made by Hustler Words. Kim is seeking both compensatory and punitive damages, in addition to a declaratory judgment affirming that xAI and SpaceX’s actions were unlawful.
