Hustler Words – Oracle has reportedly issued a force majeure notice to the primary developer behind Project Jupiter, a colossal Stargate data center campus under construction in New Mexico. This significant development was initially brought to light by Bloomberg on Thursday.
Force majeure clauses, frequently incorporated into energy and commodity agreements, serve to absolve a party from contractual obligations when unforeseen circumstances, beyond their control, impede performance. Sources familiar with the matter, as cited by Bloomberg, indicate that Oracle is not signaling an intent to withdraw as the campus’s anchor tenant. Instead, the notice would enable the technology giant to defer payments should the facility fail to achieve its ambitious 2028 operational target.
This notice emerges amidst a period of heightened national scrutiny on the construction of AI data centers, coupled with the substantial financial outlays developers are undertaking to establish the necessary infrastructure for major clients like OpenAI.

Despite the issuance of the notice, Oracle maintains an optimistic outlook. In a statement provided to CNBC, the company affirmed, "Project Jupiter is progressing according to our established timeline. We are steadfastly committed to New Mexico and confident in our trajectory forward."
Blue Owl Capital, the entity whose unit received the force majeure communication, echoed a similar sentiment in its own statement to CNBC, asserting that "this notice does not alter the financial commitments tied to this multi-year endeavor."
Neither Oracle nor Blue Owl immediately responded to inquiries from Hustler Words seeking further comment on the situation.
Nevertheless, the force majeure notification follows a series of operational challenges at the New Mexico site, many of which are intrinsically linked to its critical energy supply. The campus, engineered to manage an immense 2.45 gigawatts, is designed to operate on gas-powered fuel cells provided by Bloom Energy, making a consistent and reliable gas supply paramount to its projected timeline.
A crucial Energy Transfer pipeline, intended to deliver natural gas to the facility, has experienced delays of nearly six months, pushing its anticipated completion to February 1, 2027. These postponements stem from repeated permit rejections by regulatory bodies. Bloomberg previously reported in August that the pipeline’s route had to be modified following these regulatory hurdles. Furthermore, a separate air quality permit essential for the fuel cell system powering the campus remains pending, with the state’s environment department facing a November 23 deadline for a decision.
Project Jupiter represents one of the cornerstone initiatives of Stargate, the ambitious AI infrastructure program unveiled by Oracle, OpenAI, and SoftBank alongside President Donald Trump early in his second term. The project has attracted considerable opposition from local residents and environmental advocacy groups, evolving into a notable political flashpoint ahead of upcoming midterm elections. In response, Oracle has reportedly launched a public outreach campaign within the state, aiming to garner support and address the concerns of the project’s detractors, according to Bloomberg.
